Mark Johnson

Personal Introduction

Mark Johnson has over thirty years of experience in construction, environmental and real estate litigation matters. He has first chair experience in over 30 jury trials, bench trials and complex arbitrations concerning construction, environmental, land use, landlord-tenant, oil and gas, real estate, and toxic tort matters. Mark’s construction law experience includes representing owners, general contractors, subcontractors, and design professionals in private and public works construction litigation involving extra work claims, changed condition claims, delay claims, loss of productivity claims, defective work claims, products liability claims regarding defects in construction materials, insurance coverage for construction claims, and California contractor’s licensing laws. Mark has represented clients in arbitrations and lawsuits regarding an array of construction disputes in state and federal courts in several states as well as the federal Civilian Board of Contract Appeals and the California Public Works Contract Arbitration program. Mark is a frequent author and speaker on topics regarding the construction industry. Mark’s environmental experience includes litigation concerning CERCLA, Clean Air Act, Clean Water Act, CEQA, RCRA, the Toxic Substances Control Act, California Coastal Act, Porter Cologne Water Quality Act, Carpenter-Presley Hazardous Substances Account Act, Proposition 65; petroleum products and hazardous substance contamination of soil and groundwater; toxic torts, concerning personal injuries or wrongful death resulting from exposure to a variety of substances including asbestos, benzene, various petroleum products and hazardous substances; insurance coverage for environmental exposures; and misrepresentation of environmental conditions in real property transactions. Mark also counsel clients regarding compliance with environmental statutes and regulations. His experience includes defending clients in environmental enforcement actions brought by various government agencies, including the US Environmental Protection Agency (EPA), the California Air Resources Board, the California Department of Toxic Substances Control, various California water quality control boards and the South Coast Air Quality District. Mark also represents creditors in Chapter 7 and Chapter 11 bankruptcy proceedings, including creditors asserting environmental damage claims. Mark is Martindale-Hubbell® AV Preeminent® judicial and peer review rated and was named JD Supra®, Readers’ Choice, Top Construction Author (2017). Mark was selected by his peers for recognition in The Best Lawyers in America© 2021 and 2022. Mark has a B.S. in Petroleum Engineering and, prior to becoming a lawyer, worked as an engineer for the California Geologic Energy Management Division.
