Personal Introduction

Thomas is a former Big Law attorney with diverse expertise in complex commercial litigation, oil and gas, business formation, and other general business matters. He has successfully handled cases worth hundreds of millions of dollars in dispute at every stage of litigation and has advised companies on formation and asset acquisition. In September 2023, Thomas started his own practice to provide the same Big Law service to small- and medium-sized businesses for a fraction of the cost. Some representative matters include: ‣ Critical member of international arbitration trial team defending against more than $330 million in claims allegedly arising from a breach of a contract that provides Mexico with roughly 25% of the country’s natural gas needs. ‣ Served as critical member of team representing Litigation Trustee in a $400 Million fraudulent transfer case stemming from a private equity firm’s acquisition and subsequent series of dividend recapitalizations that over increased the debt of Tops Friendly Markets, a regional grocer, by over $500 million, culminating in the company’s eventual bankruptcy. ‣ Served as lead associate on team representing former owners of a now-defunct United States Football League (USFL), initiating trademark infringement litigation to prevent Fox Corporation from reviving the league under identical branding and trademarks. ‣ Played a key role on a team that successfully secured court approval for a Chapter 11 debtor to obtain $180 million in debtor-in-possession financing, consisting of $90 million in new capital and a $90 million roll-up of existing loans. ‣ Key member of the legal team representing a tollway construction company in defending against $400 million fraudulent transfer and fiduciary duty claims related to the development of SH-130 tollway in Austin, Texas. ‣ Represented bankrupt Brazos Electric Cooperative in challenging multiple early termination damage claims arising from substantial ISDA interest rate swaps impacted by Winter Storm Uri. ‣ Served as lead associate in representing upstart fast-fashion company, HoneyBum in antitrust action against Fashion Nova, one of the world’s largest fast-fashion retailers. ‣ Member of trial team for Cathexis, one of Texas’ largest mineral interest holders in Texas, in federal litigation against bankrupt Sanchez Energy under oil and gas lease relating to lessor substantial royalty underpayments. ‣ Member of team representing EQT, one of the the largest natural gas producers in the United States, in a number of royalty and breach of contract actions, including a class action with a potential class of exposure of over $100 million. ‣ Represented CMBS trust and special servicer in successful foreclosure of Oheka Castle, dismissal of all counterclaims, and appointment of a receiver to operate the property. ‣ Represented and advised Burrell Motor Coach in acquisition of the assets of the second largest school bus operator in Baltimore.

Thomas enjoys spending quality time with his family, particularly his 4-year-old, Eliot. In my free time, you can catch me at the park with family, golfing at the local club, at stand-up comedy show, or taking in a sporting event, especially NFL games. Go Ravens! As an Arizona native, I'm also excited to see my hometown Diamondbacks compete in the World Series against the Texas Rangers. I'll be cheering them on every step of the way and hoping for a championship win.
